SWEEPSTAKES DESCRIPTION.
Rebel Teahouse LLC (“Rebel Teahouse,” “Administrator,” “Sponsor”), located at 225 E Ponce de Leon Ave #110 Decatur, GA 30030, is giving away free lifetime bubble tea for one lucky rebel.  

​

If an Entrant is selected as a winner, the individual will receive the relevant prize described below. The complete details on how to enter can be found below in the “How to Enter” section of these Official Rules. Rebel Teahouse will select one (1) winner from the entries received. Each Entrant who enters Rebel Teahouse’s Lifetime Bubble Tea Sweepstakes (the “Sweepstakes”) must strictly follow these Official Rules and each unconditionally agrees to comply with, be subject to and fully abide by these Official Rules and the decisions of Rebel Teahouse, whose decision shall be final and binding in all respects, concerning the Sweepstakes.

NO PURCHASE NECESSARY.
No purchase or payment is necessary to enter or to win. A purchase will not increase your chances of winning. All federal, state, local, and municipal laws and regulations apply. This Sweepstakes is void where prohibited by law.

 

ENTRY PERIOD.
The Sweepstakes entry period begins on May 15, 2022 at 12:01 am EST and ends on September 30, 2022 at 11:59 pm EST (the “Sweepstakes Period”). It may be extended or shortened at Rebel Teahouse’s sole discretion. Rebel Teahouse will be the official timekeeper for the Sweepstakes. Entries that are submitted before or after the Sweepstakes Period will be disqualified.

ELIGIBILITY.
Except where prohibited by law, the Sweepstakes is open to all legal U.S. residents residing in the state of Georgia (GA). The age limit to enter and participate in the Sweepstakes is at least thirteen (13) years old at the time of entry. Those in the age range of 13 – 17 (the “Minors”) must have a parent or legal guardian’s permission prior to entering. Transfer of any rights to Sweepstakes’ entry materials and/or prizes by any person to another person is strictly prohibited and shall be void.

ELIGIBILITY FOR MINORS. 
To enter the Sweepstakes, you must have the permission of your parent or legal guardian (“Parent“) prior to entering and be: (i) a legal resident of the state of Georgia in the United States (the “Eligibility Area“), and (ii) be at least the age of thirteen (13) at the time of entry (each an “Entrant“, collectively the “Entrants“).

Each Entrant age 13 – 17 at the time of the sweepstakes entry must have the permission of his/her Parent prior to entry and such entry shall be deemed submitted by the Parent and shall be treated as if the Parent had made such entry and if chosen as a winner, the Prize (hereinafter defined) will be awarded in the name of his/her Parent. Eligibility will be determined by Sponsor and/or Administrator in its/their sole discretion. By participating in the Sweepstakes, each Entrant and his/her Parent agrees to these Official Rules and all the decisions of Sponsor or Administrator, which are final and binding in all respects.

HOW TO ENTER.
Participants will gain entry into the Sweepstakes, during the Sweepstakes Period, by visiting the 
website at http://rebelteahouse.com/lifetime-bubble-tea/ (the “Sweepstakes Site“) and following the instructions to complete and submit the online Sweepstakes entry form.

​

Information must be complete and must be submitted in accordance with the online directions. Use of a profane username or the submission of false or misleading personal information by an Entrant will be grounds for disqualification. Determination of information to be profane, false, or misleading is at the sole discretion of the Sponsor. Entrants who submit an entry must provide all required information. Incomplete or inaccurate entries are void.

As stated below, collection and use of personally identifiable information will be in accordance with the Sponsor’s online Privacy Policy as posted on www.rebelteahouse.com/privacy-policy.

​

All entries become the property of Administrator and Sponsor and will not be acknowledged or returned.

​

Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Administrator, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.

​

DRAWING AND NOTIFICATION.
One (1) potential winner (the “Potential Winner”) will be randomly selected from the eligible entries received. That individual will be selected on or about October 15, 2022.

​

The odds of winning are dependent upon the number of eligible entries into the Sweepstakes received during the Sweepstakes Period.
 
On or about October 15, 2022, the Administrator will attempt to notify the Potential Winner via email only at the email address provided to Rebel Teahouse in the entry form.

​

The Potential Winner (parent/legal guardian if a minor in his/her state of residence) will be required to complete, electronically sign and submit an Affidavit of Eligibility, Publicity Waiver, Release of Liability and Indemnification and a W-9 Federal I.D. form (the “Required Documents”) within seven (7) days of receipt of notification of winning and has three (3) days to reply with confirmation of receiving email.

​

The Potential Winner’s failure to do so constitutes forfeiture of the Prize and the Prize will be awarded to an alternate winner (the “Alternate Winner”). If the prize notification is unsuccessful, or in the event of non-compliance with any of these rules, regulations, terms or conditions, the Prize will be forfeited, and the Alternate Winner may be selected from the remaining eligible entries. Only three (3) alternate drawings will be held, after which the Prize will remain un-awarded.

The Potential Winner must be able to provide proof that the Potential Winner is eligible to be deemed an Official Winner to Sponsor and/or Administrator’s satisfaction. Rebel Teahouse reserves the right and insists that any Entrant receiving a prize present valid state photo identification proving they were 13 years of age or older at the time of entry and their identity and state of residence.

If the Potential Winner is at least 18 but still considered a minor in his/her jurisdiction of residence, Sponsor reserves the right to award the Prize in the name of his/her parent or legal guardian, who will be required to sign the Required Documents and any other legal documents that Sponsor and/or Administrator may require, on the Potential Winner’s behalf and fulfill any other requirements imposed on the winner set forth herein. The Potential Winner must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements.

 

Rebel Teahouse reserves the right to void any entry or winner not in compliance with the rules stated above or below. Prize acceptance constitutes permission, in perpetuity, by the winner (except where prohibited by law) to use, print, publish and broadcast in any media at any time, the winner’s name, photograph, identity, portrait, voice, likeness and biographical information for publicity purposes without additional compensation or review.

​

In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Sweepstakes is unable to run as planned for any other reason, as determined by Administrator in its sole discretion, the Administrator may, in its sole discretion, either (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Sweepstakes and, in the event of termination, award the Prize at random from among the eligible, non-suspect entries received up to the time of the impairment.

The Administrator reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Administrator reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Administrator to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

SWEEPSTAKES PRIZE.
Rebel Teahouses’ LIFETIME Bubble Tea Sweepstakes will choose one (1) winner at random and the official winner (“Official Winner”) will receive a prize (“the Prize”) with an approximate value of $133,590.00 USD. The Prize grants the Official Winner one free order of a single bubble tea beverage every day from the official menu on-site, of any available size and with any one available topping. This Prize can only be used in-person at Rebel Teahouse’s physical location(s). 

 

The ability to activate the Prize will commence approximately three (3) weeks, but no later than six (6) weeks, after the conclusion of the Sweepstakes, at which time the Official Winner will receive notice of commencement of their free lifetime bubble tea (“Prize Period”). The ability to place the free bubble tea order will reset at midnight every day. The Prize must be accessed and utilized during the Prize Period at least once every five (5) years; failure to activate the Prize at least once in a five (five) year period will terminate the Prize and end the Prize Period. 

 

The Prize is non-transferrable. The Prize may not be redeemed for cash. No substitution of the Prize may be requested by the winner. Rebel Teahouse reserves the right to substitute a prize of equal or greater value for any reason at the sole discretion of Rebel Teahouse if the Prize is unavailable for any reason. In no event will Rebel Teahouse award more prizes than are provided for in these Official Rules.

As set forth below, the individual accepting receipt of the Prize identified herein will be responsible for all taxes associated with the Prize and/or other costs related to acceptance or use of the Prize. Any and all prizes awarded shall be subject to verification of the Entrant’s eligibility and compliance with the terms of these Official Rules by Rebel Teahouse.

Any and all other travel-related fees to acceptance of the Prize, as well as taxes owed by the winner accepting receipt of the Prize as a result of the Sweepstakes, gratuities, and any and all other personal and/or incidental costs and expenses of any nature whatsoever, are the sole responsibilities of the winner.

​

THE TOTAL APPROXIMATE RETAIL VALUE (THE “ARV” OF THE PRIZE MAY VARY DEPENDING ON THE AGE OF THE OFFICIAL WINNER, MENU SELECTIONS AND OTHER FACTORS. THE DIFFERENCE BETWEEN THE ARV AND THE ACTUAL VALUE OF THE PRIZE WILL NOT BE AWARDED.

CONTINUAL/TRANSMISSION USE.
Rebel Teahouse may from time to time email you specials, offers, features, promotions or advertising that it deems appropriate. By entering the Sweepstakes, you agree to these terms and conditions and agree to accept such email messages. Entrants will be provided an option to opt out of any additional email messages. It is the Entrants’ responsibility to opt out of receiving any additional email messages.

TAXES, OTHER COSTS, MISCELLANEOUS.
Any and all applicable federal, state and/or local taxes (which may include, without limitation, sales tax and income tax) will be the sole and exclusive responsibility of the persons accepting receipt of the prizes identified herein. Individuals accepting prizes will be required to give their social security number in order to prepare any necessary tax forms and must further sign and deliver any and all necessary documents to complete the transfer of any prizes to be awarded. Individuals accepting prizes shall be responsible for any sales taxes or other taxes due as required by law. Individuals accepting prizes are solely responsible for any additional expenses associated with acceptance, receipt and use of the prizes, including but not limited to miscellaneous personal travel expenses (if applicable).

NO ASSIGNMENT. 
No assignment and/or transfer of any kind of any prize, alternative prize or other substitution is permitted in the absence of Rebel Teahouse’s express written consent (which shall be in Rebel Teahouse’s sole and exclusive discretion), and any such prohibited assignment and/or transfer shall be void.

​

CONSENT TO OFFICIAL RULES/NO WAIVER. 
Participation in the Sweepstakes constitutes each and every Entrant’s understanding of and full and unconditional agreement to and acceptance of these Official Rules. Entrants understand and agree that they are subject to the individual Terms of Use and Privacy Policy for Rebel Teahouse or any other website utilized in connection with the Sweepstakes. Rebel Teahouse reserves the right at its sole discretion to disqualify any entry that Rebel Teahouse determines to be in violation of any term contained in these Official Rules or any of the host website's Terms of Use or Privacy Policy. The decision and/or action of Rebel Teahouse not to enforce a specific provision of these Official Rules or any of the host website's Terms of Use or Privacy Policy does not constitute a waiver of any provision herein or of these Official Rules in general, and shall not prohibit Rebel Teahouse from proceeding and/or enforcing these Official Rules in the future. Rebel Teahouse may enforce these Official Rules cumulatively, meaning singly, concurrently and/or in any such manner as Rebel Teahouse sees fit without waiving them in any capacity.

 

LIMITATIONS OF LIABILITY/RELEASES.
By participating in the Sweepstakes, entrants agree to release and hold harmless the Administrator and Sponsors, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Sweepstakes, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Sweepstakes, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Sweepstakes; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d)application downloads, (e) any other errors or problems in connection with the Sweepstakes, including, without limitation, errors that may occur in the administration of the Sweepstakes, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloading of the application, the processing of entries application downloads or in any Sweepstakes-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Sweepstakes or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). 

 

Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the entrant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

 

A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.

CHOICE OF LAW/VENUE. 
Except where prohibited, Entrants agree that the exclusive venue for any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded hereunder shall be Dekalb County Georgia Superior Court. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrants and Rebel Teahouse in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the State of Georgia, without giving effect to any conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than Georgia. All Entrants and winners agree, by their participation in the Sweepstakes, to submit to personal jurisdiction in the State of Georgia and, more particularly, the County of DeKalb and waive any and all rights of removal to Federal District Court.

 

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Georgia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Georgia, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Information collected from entrants is subject to Sponsor’s privacy policy.

PUBLICITY. 
EXCEPT WHERE PROHIBITED BY LAW, PRIZE WINNER GRANTS TO SPONSOR (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR) THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, PRIZE WINNER’S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, AND BIOGRAPHICAL INFORMATION FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON ANY FORM OF MEDIA) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION. PARTICIPANTS AGREE THAT SPONSOR SHALL OWN THE SWEEPSTAKES ENTRIES, WHICH WILL NOT BE ACKNOWLEDGED OR RETURNED, AND THAT SPONSOR AND ITS DESIGNEES SHALL HAVE THE PERPETUAL, WORLDWIDE RIGHT TO EDIT, PUBLISH, AND USE THE SWEEPSTAKES ENTRIES IN ANY WAY AND IN ANY MEDIA FOR TRADE, ADVERTISING, PROMOTIONAL, AND/OR OTHER PURPOSES AS SPONSOR AND/OR ITS DESIGNEES MAY DETERMINE WITHOUT FURTHER CONSIDERATION TO PARTICIPANTS OR ANY THIRD PARTY.

 

ADDITIONAL TERMS.
Proof of submission of an entry will not be deemed to be proof of receipt by Rebel Teahouse. Rebel Teahouse is not responsible for any typographical, technical, or other error in the Sweepstakes offer, administration of the Sweepstakes or in the announcement of a prize winner.

 

In the event of a printing/production/typographical error, irregular or invalid code/message or equipment error, Rebel Teahouse shall have no liability.

In the event Rebel Teahouse is prevented from continuing with the Sweepstakes or the integrity and/or feasibility of the Sweepstakes is severely undermined by any event beyond the control of Rebel Teahouse, including but not limited to fire, flood, epidemic, pandemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), event cancellation, terrorist threat or activity, or any federal, state or local government law, order, or regulation, order of any court or jurisdiction, infection by computer virus, unauthorized intervention, technical failures, intervention by Instagram® or other cause not reasonably within the control of Rebel Teahouse (each a “Force Majeure” event or occurrence), Rebel Teahouse shall have the right, in its sole discretion and without any recourse or liability to any Entrant, to abbreviate, modify, suspend, cancel or terminate the Sweepstakes as circumstances may require. If Rebel Teahouse, in its discretion, elects to cancel or alter this Sweepstakes as a result of a Force Majeure event, a notice will be posted on http://www.rebelteahouse.com.

SEVERABILITY. 
The invalidity or unenforceability of any provision of these Official Rules shall not affect the invalidity or unenforceability of any other provision so long as the general intent of these Official Rules remains in effect. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

OFFICIAL RULES.
Rebel Teahouse reserves the right to change, alter, or amend these Official Rules as necessary, in its sole discretion, to ensure the fair administration of the Sweepstakes or to comply with applicable law. INDEMNIFICATION.
BY ENTERING THE SWEEPSTAKES, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS REBEL TEAHOUSE AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. SPONSOR AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE.
